Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and [LEGAL_ENTITY_NAME], doing business as “Tipsy Rock” (“Tipsy Rock,” “we,” “us,” or “our”), located at 710 Kings Bay Rd, St Marys, GA 31558. They govern your access to and use of our website and your purchase of products from us (collectively, the “Services”).

By accessing the Services, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 21 years of age to use the Services, place an order, or receive alcohol from us. By using the Services you represent and warrant that you are 21 or older and that any alcohol you purchase is for personal consumption by a person 21 or older and not for resale.

The age confirmation presented when you first visit the site is a notice and acknowledgment only. It is not identity or age verification. Legally binding age verification occurs in person at the time of pickup or delivery (see Section 6).

It is unlawful to purchase alcohol on behalf of, or to furnish alcohol to, any person under 21. We may refuse or cancel any order and refuse handoff to anyone who cannot verify their age and identity.

You may need an account to place orders. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your credentials and all activity under your account. Notify us promptly of any unauthorized use.

We may suspend or terminate accounts that violate these Terms, provide false information, or that we reasonably believe are associated with unlawful activity.

All orders are offers to purchase and are subject to our acceptance. We may decline, limit, or cancel any order — including after it is placed — for reasons including product availability, pricing errors, quantity limits, suspected fraud, or inability to verify age or identity.

Pricing and totals. Prices are shown in U.S. dollars. The order total, applicable taxes, and any fees are calculated and confirmed by us on our servers at checkout; the amounts displayed there govern. Sales tax is applied at a flat rate of [TAX_RATE]% [TAX_JURISDICTION] as computed at checkout.

Payment. Payments are processed by our third-party payment processor, Stripe. By submitting payment information you authorize the applicable charge. We do not store full card numbers; card data is handled by the processor under its own terms. Depending on fulfillment method, payment may be captured at checkout, at pickup, or at delivery, as indicated during checkout.

We offer two fulfillment methods only: in-store pickup at 710 Kings Bay Rd, St Marys, GA 31558, and local delivery within our service area. We do not ship alcohol and do not offer interstate or common-carrier shipping.

Service area. Local delivery is available only to addresses within approximately 5 miles of our store, as determined by us at checkout. Orders to addresses outside the service area cannot be delivered and will be offered as pickup instead.

Timing. Pickup and delivery are available only during lawful hours and days for alcohol sales in our jurisdiction and during our posted operating hours. Estimated times are not guaranteed.

Every order requires valid, government-issued photo ID proving the recipient is 21 or older at the time of handoff, whether at pickup or delivery. This requirement applies to all orders and is not optional.

You acknowledge and agree that we or our delivery personnel will:

• require the recipient to present valid, unexpired photo ID;
• refuse handoff to anyone who cannot present valid ID;
• refuse handoff to anyone who appears intoxicated or who we reasonably believe is purchasing on behalf of a minor or an intoxicated person; and
• refuse handoff to anyone other than a person 21 or older able to verify their identity.

If handoff is refused for these reasons, the order may be canceled and is subject to the refund and restocking terms in Section 7.

Because of the nature of alcohol sales, returns and refunds are limited. [RETURN_POLICY_SUMMARY] Alcohol that has been handed off generally cannot be returned except as required by law or where a product is defective or was fulfilled in error.

You may request cancellation before an order is prepared or dispatched; we will honor such requests where reasonably possible. Refunds, where due, are issued to the original payment method through our payment processor.

You agree to comply with all applicable laws regarding the purchase, possession, and consumption of alcohol. You will not use the Services to purchase alcohol for anyone under 21, for resale, or for any unlawful purpose. We sell under license number [LICENSE_NUMBER] issued by [LICENSING_AUTHORITY].

You agree not to:

• provide false information, including about your age or identity;
• use the Services in violation of any law or these Terms, or to facilitate underage or unlawful alcohol access;
• interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or related systems; or
• scrape, copy, or misuse content or data except as expressly permitted.

The Services, including text, graphics, logos, the Tipsy Rock name and brand, and their selection and arrangement, are owned by us or our licensors and protected by applicable law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended personal, non-commercial purpose. Product names, brands, and images may be trademarks of their respective owners.

We rely on third-party providers to operate the Services, including payment processing (Stripe), hosting and infrastructure, database and authentication services, and transactional email. Your use of features powered by these providers may be subject to their terms and privacy practices. We are not responsible for third-party services we do not control.

Except as expressly stated and to the fullest extent permitted by law, the Services and products are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, in no event will Tipsy Rock, its owners, or its personnel be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to the Services or these Terms. Our total liability for any claim will not exceed [LIABILITY_CAP].

You agree to indemnify and hold harmless Tipsy Rockand its personnel from claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of law, including any furnishing of alcohol to a person under 21.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in [COUNTY/VENUE], Georgia, unless the parties agree otherwise.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where required, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
